Bill C-27 The Canadian Electronic Commerce Protection Act #On the 24th of April, a new law was put into effect, called the Canadian Electronic Commerce Protection Act.
Basically in a nutshell, the law is aimed at a few different types of people, bad guys out there who send out fraud emails like credit card phishing and spyware, cell phone txt message spam and other forms of unsolicited email. This also includes marketing of products, services etc, if the person receiving the email did not ask for it, then you are violating the new law.
The new law states that "This bill would allow businesses and consumers to take civil action against anyone who violates the ECPA"
Yes that is correct, CIVIL action, not CRIMINAL, basically the offenders will be brought before the courts with a civil lawsuit then they will settle behind closed doors for in most cases one small fraction of the profit they made through their "spam" activities and then will move on to their next venture, no criminal record, no prison, no headaches, just pay the person or company that is suing you off, a few thousand or hundred thousand at most (pocket change) then move on to the next venture and make a few more million, get sued again and settle again, it is all a cost of doing business, or look at it as paying a toll. If you have the right legal representation and you have the right timing, you can settle out of court for much less then the cost of setting up your whole venture to begin with.
One of my closest associates made 4.7 million usd profit, got sued by an American corporation, he decided to have his lawyers meet with their lawyers, he was being sued for over 60 million, anyhow, long story short, he settled out of court for just over 300k usd and signed paperwork saying he would never sell a few products every again. Quite simply he paid 300k to make 4.7 million, his business ran for 8 months. He now laughs about it while sipping martini's on his patio in the Bahamas at one of his many properties.
Thats just one example of how "damaging" a civil action lawsuit can be.
